The Jharkhand High Court has granted protection from coercive action to Sudhir Chaudhary, Consulting Editor at AajTak, India Today's sister channel. The high court adopted a recent order by the Supreme Court granting protection to Chaudhary.
A case was filed in Jharkhand against Sudhir Chaudhary under the SC/ST Act for allegedly making remarks against the tribal community after the arrest of former Chief Minister Hemant Soren in January.
Chaudhary's counsel had submitted in the Supreme Court that no offence under the SC/ST Act had been made out against him.
The top court then issued notices to the state police and other authorities, directing that no coercive steps be taken against him pending further orders.
Chaudhary had approached the Supreme Court after the Jharkhand High Court refused to grant interim protection to him.
After the top court's order granting him protection from arrest, the high court followed suit. The order was passed by a bench of Justice Rajesh Kumar.
The Jharkhand High Court also clubbed three pleas seeking the quashing of FIRs and decided to take up the case after the top court decided Chaudhary’s special leave petition.
During the hearing, Advocate Rajesh Shukla and Ansul, appearing for Chaudhary, told the court that they confined their pleadings only to allegations made by the complainants and not the alleged "victim", Hemant Soren.
