SC stays HC order nullifying election of Odisha Congress MLA

NEW DELHI: In relief to Congress MLA

,

Supreme Court

has stayed order of

Orissa high court

(HC) which had nullified his election.
HC on March 4 annulled his election on grounds of “suppression of

criminal cases

pending against him”. It also observed that his

affidavit

was not properly checked by the returning officer and declared it invalid.

The politician thereafter rushed to SC through his advocate Mithu Jai for stay on the order.
Granting him relief, a bench of Justices Surya Kant and Justice K V Viswanathan stayed HC order and issued notice on his plea.

had challenged Moquim’s election in 2019 after losing the polls by 3,827 votes. Samantray, who was elected to

Rajya Sabha

last month, also alleged that Moquim did not disclose correct facts about his assets and liabilities.
