in any form. But it is a country’s courts – especially the top court – that is expected to step up and protect people’s rights at such times, according to
senior Supreme Court lawyer
Mihir Desai.
Desai was speaking on ‘the evolution in jurisprudence after the Emergency in 1975’ at a seminar organised by the Campaign for Judicial Accountability and Reforms (CJAR) in Mumbai last week.
