High Court to hear Congress plea against I-T case order today

NEW DELHI:

Congress

on Tuesday approached

Delhi High Court

challenging the

tax reassessment proceedings

initiated against the party by the income tax department.
A bench of acting Chief Justice Manmohan and Justice Manmeet PS Arora directed the

high court

registry to list the matter for hearing on Wednesday. Last week, the high court had upheld a March 8 order by the

Income Tax Appellate Tribunal

(

ITAT

), which dismissed Congress’s application seeking a stay on I-T department’s Feb 13 notice initiating the recovery of outstanding tax amount of more than Rs 105 crore.

The court had, however, granted liberty to the party to approach ITAT afresh.
In its plea before the HC, the party had sought a stay on tax recovery proceedings and freezing of its bank accounts, and had argued that the I-T department had illegally encashed some of the amounts lying in its bank accounts without waiting for the outcome of the court hearing.
