Delhi LG office to Centre: AAP govt filing false cases

NEW DELHI: The office of lieutenant governor V K Saxena has written to the

alleging that concerted attempts were being made by

AAP govt

in the capital to "mislead" courts by filing "motivated and premeditated petitions" with the apparent aim of "influencing" the

justice delivery system

.
In a five-page communication, Saxena's principal secretary Ashish Kundra alleged that "patently false affidavits" were being filed by the elected dispensation to secure an endorsement for such motivated petitions.

"GNCTD vs LG in various matters in different courts has become the prevalent norm, rather than an exception," he said, referring to specific cases. "The attempts obviously are, apart from misleading the courts, (intended) to create a false media narrative which maligns the constitutional office of LG in public domain."

Kundra referred to several cases that are currently before Supreme Court and Delhi high court, arguing that it not only "overburdened" the judiciary but also caused expenditure of crores of rupees on "scurrilous" litigation and wastage of time of public officials.
"Such attempts, apart from misleading the courts, create a confusing and skewed narrative that maligns the image of LG," stated the letter.

The LG's office pointed out that the Delhi water minister recently filed a civil petition in Supreme Court seeking directions to the LG to instruct the finance department to release funds to Delhi Jal Board. The matter was a "smokescreen, aimed at creating a negative imagery about the LG" as both finance and water are transferred subjects, the official said.

"LG has no role, whatsoever, in decisions taken thereof and no file, whatsoever, is routed through him," he said, adding that the SC, after hearing the argument, decided not to issue a notice to LG on the very first date of hearing.
Referring to a petition filed by Delhi Commission for Protection of Child Rights in Delhi HC complaining that its funds had been stopped by the LG, the official said that the petitioner had to withdraw it after 10 hearings when a special counsel vehemently contested the claims.
The official claimed in the letter that the standing counsel of Delhi govt made "patently false and misleading statements", projecting the LG and his office in a poor light in a case related to the identification and classification of conforming and non-conforming wards in the capital for implementation of the now-rescinded excise policy. He claimed that a court-appointed committee submitted its report in Aug 2022 to govt and the file was received by the LG secretariat only in Jan 2024, but the govt counsel misled HC by claiming it was pending with the LG all this while.
Kundra said Delhi govt filed a petition in SC attributing stoppage of the 'Farishtey' scheme to the LG and the issue was "played up" in the media as a supposed "legal tussle".

"...This again was an attempt to obfuscate the issue and mislead Supreme Court by casting the responsibility of a 'transferred subject' on LG," the official said. He said the number of beneficiaries and the money spent on the scheme "neither indicate a halt", nor support the allegations of "non-payment" as claimed by the minister and "endorsed by the chief minister".
On proposals pertaining to upgrade of judicial infrastructure in Delhi high court and district courts, Kundra said in his letter that it was only after Saxena invoked the relevant section of Transaction of Business Rules of Govt of NCT of Delhi Act, 1993, seeking the files that the law minister cleared them. He added that the projects had already been cleared by high court in 2019 and were pending with govt.
Supreme Court too had come down heavily on Delhi govt for keeping the proposals pending for such a long period, he added.
