Jaipur: Thirty-three years after a man was sentenced to five years in jail by a sessions court for a murder attempt on his wife,

Rajasthan HC

has

acquitted

him, saying the charges could not be conclusively established.
Justice Anoop Dhand

said prosecution failed to present any independent or natural witness to substantiate the allegation made in the

FIR

that the man threw his wife into a well.
The case dates back to Aug 1989, when one Chhotu Ram filed an FIR alleging that Kalu Ram, who had been married to his niece Bhanwari for four years, beat her up and threw her into a well, but some people rescued her.
The trial court found Kalu Ram guilty of

attempted murder

and sentenced him on Dec 4, 1991. Kalu then moved the high court, which suspended his sentence on Dec 18, 1991. Since then, he has been on bail, after spending a total 65 days in custody during the investigation, trial and appeal process.
